ENTRY RULES

Contest begins October 30, 2008 at midnight (12:00:00 a.m.) US Eastern Standard Time and ends January 15, 2009, 11:59:00 pm US Eastern Standard Time.
 
Who May Enter
Participation in this contest constitutes full and unconditional agreement to, and acceptance of, the Official Contest Rules.

Contest is open only to those who have reached the age of majority in their jurisdiction of residence at the time of entry.  Each person may submit one entry per category.  Employees of Navico, and its subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not related are not eligible. CONTEST IS VOID WHERE PROHIBITED.

How to Enter
You must upload both a screenshot JPEG (for judging), and a chart recording .slg (for verification of authenticity/no alterations).  Upload your screenshots and .slg files along with contact details to the Lowrance website between October 30, 2008 at midnight (12:00:00 a.m.) US Eastern Standard Time and January 15, 2009, 11:59:00 pm US Eastern Standard Time.

Uploaded files are to be 10MB max for SLG and 500KB max for JPEG.

Each person may submit one entry per category. If you wish to submit a different screenshot for each category, then you must fill out the entry form twice.

Any submissions that do not fulfill the technical requirements will be rejected and will be ineligible to participate.  In addition, submitted photographs may not be digitally, or otherwise, altered.  Any winning photograph found to be altered will be disqualified from winning.

Entrant must be the owner of the photograph, or control all right, title and interest to the photograph, including the right to submit the photograph for consideration in the contest.  All photographic entries become the property of Navico and will not be returned.

Navico reserves the right, in its sole discretion, to accept or reject any content, without notice or liability to you or to any third party.

Contest Prizes
One prize will be awarded in each category.  Winners will be notified by e-mail and must respond within ten (10) calendar days, calculated from the date and time the notification is sent to the winner by Navico.  Winners are subject to approval by Navico pending confirmation of the winner’s compliance with the Official Contest Rules.  Winners must agree to satisfy all conditions and terms of eligibility as established by Navico, and must execute any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form before any prize is awarded.

Winners will receive a 2009 Lowrance GPS chartplotter which is compatible with the Lowrance Broadband Sounder-1.  No prize transfer, assignment, or substitution by winners permitted. If a prize (or part of a prize) is unavailable, Navico, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize of the equal monetary value and/or specification, unless to do so would be prohibited by law.  If for any reason whatsoever a winner does not take the prize then the prize will be forfeited by the winner and neither cash nor kind will be awarded in lieu of the prize.

Judging
Deepest Depth category – Judges will be looking for the deepest possible reading, any transducer option is allowed.

Structure/Fish Target category – Judges will be looking for shots that highlight the ability of the Broadband Sounder to discern targets, with focus on good target separation and discrimination. The winner will have an attractive screen with interest, with sensitivity and Colorline™ set to maximum color palette/fishing mode selected.

Decisions of the Judges are final and binding and Navico’s decisions are final on all matters relating to this contest..

License
By submitting content in this contest, you represent and warrant that you are the owner of and control all right, title and interest to the photograph, that there are no other agreements with any other party in conflict with those rights, and that you have the right and power to grant to Navico a nonexclusive, perpetual, transferable, sublicensable, royalty-free, irrevocable, worldwide license to reproduce, prepare derivative works of, distribute, and publicly display and perform that content for any purpose and in any media, including without limitation by making that content available for downloading by third parties or by incorporating all or part of that content into other materials. You hereby irrevocably waive any claim based on moral rights, if any, in that content.

Entrants will not receive financial or other compensation, and release Navico and any entity acting on Navico’s behalf from any liability with respect thereto.

Limitation of Liability
By entering this Contest, all entrants agree to release, discharge, and hold harmless Navico and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.  Navico assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries; or alteration of entries. Navico is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants’ or any other persons’ computers related to or resulting from participation or uploading or downloading of any materials related to in this Contest.

Only fully completed entries actually received by Navico are eligible for entry in the contest.  Proof of submission will not be deemed to be proof of receipt by Navico.

Entries will be deemed to be made by the authorized account holder of the e-mail address submitted at the time of entry.  “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  All entries must be submitted with a valid e-mail account that may be identified with a natural person by appropriate independent means, including, without limitation, reverse domain name search.

Conditions
THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be governed by and subject to the laws of the State of Oklahoma and the forum for any dispute shall be in Tulsa County, State of Oklahoma, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief, or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and any entrant expressly waives any and all such rights. Certain restrictions may apply.

Entries are void if Navico determines the entry to be damaged, irregular, altered, counterfeit, produced in error, or obtained through fraud or theft.  By entering, entrants also agree (a) to be bound by the Official Contest Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Navico may use the winning entry and each winner’s name in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law).

All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prizewinner.

In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or does/do not respond within ten (10) calendar days to a winner notification as required by the "Official Contest" Rules above, or refuses/refuse the prize, the prize will be forfeited, and Navico, in its sole discretion, may choose whether to award the prize to another entrant.

The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

Navico is not responsible for typographical, printing, or other inadvertent errors in these rules or in other materials relating to the contest.

Right to Cancel or Suspend Contest
If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes which in the sole opinion of Navico corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Navico reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Navico elects to cancel or terminate the Contest, Navico will not retain any rights to the submitted entries.

Winners List
Entrants are responsible for complying with the Official Contest Rules. Winners’ names will be available online at www.lowrance.com during the Miami Boat Show, February 12-16, 2009.

Data Privacy
Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in the Official Contest Rules. The data may also be used by Navico in order to verify the participant’s identity, postal address, and telephone number or to otherwise verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify, or cancel any personal data held by Navico by writing to Navico at Lowrance Broadband Sounder Competition, 12000 East Skelly Drive, Tulsa, Oklahoma, 74128.   Personal data will be used by Navico and its affiliates exclusively for the purposes stated herein.
